General terms of use and sale

These general terms of use and sale (“Terms”) govern access to and use of the Klaivo service (the “Service”), published by Klaivo.co (SAS), 128 Rue de la Boétie, 75008 Paris, France. By creating an account or using the Service, you accept these Terms without reservation.

1. Description of the Service

Klaivo is an online service that generates video advertisements using artificial intelligence from a brief, parameters and, where applicable, a product image provided by the user. The Service includes the generation of scripts, voiceovers, music and automatic editing. The Service is published by Klaivo.co (SAS).

2. Account

Using the Service requires creating an account. You are responsible for the accuracy of the information provided and for the confidentiality of your credentials. The Service is reserved for adults.

3. Credits

• Use of the Service is based on a credit system. Each generation consumes a number of credits shown before it is launched.
• If a generation fails, the corresponding credits are automatically credited back.
• Credits have no monetary value, are not refundable once consumed and cannot be converted into cash.
• Subscription credits are refreshed at each billing cycle.

4. Plans, prices and payment

• The Service offers paid plans (monthly or annual) as well as one-off credit top-ups.
• Prices are shown and charged in US dollars (USD) on the Pricing page. If your bank account is held in another currency, the amount actually debited depends on your bank’s exchange rate and may include conversion fees.
• Payments are processed securely by Stripe. We do not store your card details.
• Subscriptions renew automatically at each term, until cancellation.

5. Cancellation

You can cancel your subscription at any time from your “Plans & billing” area. Cancellation takes effect at the end of the current period; no pro-rata refund is due for the period already started, unless a mandatory legal provision states otherwise.

6. Right of withdrawal

In accordance with Article L.221-28 of the French Consumer Code, you acknowledge that the Service consists of the supply of digital content whose performance begins immediately after your order, with your express consent. You thereby waive your right of withdrawal for credits already consumed. Unconsumed credits may be refunded within the legal period of 14 days, where applicable.

7. Ownership of generated content

Subject to full payment of the credits and subscriptions due, the videos and content you generate belong to you and may be used freely, including for commercial purposes. You are solely responsible for the content you upload (in particular product images) and warrant that you hold the rights to it.

8. Prohibited uses

• Generating illegal, deceptive, defamatory, hateful content or content that infringes third-party rights.
• Uploading content to which you do not hold the rights.
• Circumventing the credit system, automating abuse or disrupting the Service.
• Impersonating a brand or a third party.

Any breach may result in the suspension or deletion of the account, without refund.

9. Availability and liability

The Service is provided “as is”. We strive to ensure its availability but do not guarantee the complete absence of interruption. Results generated by AI may contain imperfections; it is your responsibility to check them before publication. Our liability shall not exceed the amounts you paid over the last 12 months, within the limits permitted by law.

10. Changes to the Terms

We may modify these Terms. Users are informed of substantial changes. Continued use of the Service constitutes acceptance of the version in force.

11. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the French courts shall have jurisdiction. Consumers may use a consumer mediator. Contact: contact@klaivo.co.
